FAIRWAY365 REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy ("Policy") applies to reservations, memberships, purchases, credits, promotional offers, and other services purchased from Fairway365, operated by Kushi Arav 24 LLC.
By making a reservation, purchasing a membership, or purchasing any Fairway365 service, you acknowledge and agree to this Policy.
1. GENERAL REFUND POLICY
Unless otherwise stated in this Policy or required by applicable law, all purchases are final and are not automatically refundable.
Fairway365 may provide refunds, credits, or other remedies at its discretion when appropriate.
Nothing in this Policy is intended to waive or limit any rights that cannot legally be waived.
2. RESERVATION CANCELLATIONS
Customers may cancel a reservation through the Fairway365 booking system or by contacting Fairway365.
Cancellations 24+ Hours Before Reservation
If a reservation is cancelled at least 24 hours before the scheduled start time, the customer may be eligible for:
- A full refund to the original payment method; or
- An account credit, at the customer's election when available.
The applicable cancellation option displayed during checkout will control if it differs from this general policy.
Cancellations Less Than 24 Hours Before Reservation
Reservations cancelled less than 24 hours before the scheduled start time are generally non-refundable.
Fairway365 may, at its sole discretion, provide an account credit or partial refund in exceptional circumstances.
Providing a credit or refund for one cancellation does not create an obligation to provide the same accommodation for future cancellations.
3. NO-SHOW POLICY
If you fail to attend a reservation without cancelling it in accordance with this Policy, the reservation may be considered a no-show.
No-show reservations are generally not refundable.
Fairway365 may charge the full reservation amount for a no-show.
Repeated no-shows may result in:
- Loss of cancellation privileges;
- Booking restrictions;
- Membership suspension;
- Membership termination; or
- Other reasonable restrictions.
4. LATE ARRIVALS
Your reservation begins at the scheduled start time.
Arriving late does not automatically extend your reservation.
For example, if you reserve a bay from 5:00 PM to 6:00 PM and arrive at 5:20 PM, your reservation still ends at 6:00 PM.
Unused time caused by late arrival is generally not refundable.
5. EARLY DEPARTURES
Leaving before the end of your reservation does not automatically entitle you to a refund or credit.
If you voluntarily stop using your reserved time, the remaining unused time is generally forfeited.
6. MEMBERSHIP CANCELLATION
Memberships may be cancelled through the cancellation method made available by Fairway365.
For automatically renewing memberships, cancellation must be completed before the next renewal date to prevent the next recurring charge.
Cancellation generally stops future renewal but does not automatically provide a refund for:
- Previous membership charges;
- Partially used membership periods;
- Unused membership benefits;
- Unused booking privileges; or
- Remaining time in a billing period.
7. MEMBERSHIP REFUNDS
Unless required by applicable law or expressly stated in the applicable membership agreement, membership payments are generally non-refundable.
If a membership is cancelled after a renewal payment has been processed, the membership may remain active through the end of the applicable paid membership period.
Fairway365 generally does not provide prorated refunds for unused portions of a membership period.
8. MEMBERSHIP PRICE CHANGES
Fairway365 may change membership prices prospectively.
Where required by applicable law, customers will receive notice of material price changes before the change becomes effective.
If you do not agree to a future price change, you may cancel your membership before the applicable renewal date.
9. PROMOTIONAL PURCHASES
Promotional purchases, discounted bookings, introductory offers, special packages, credits, and promotional memberships may have additional restrictions.
Unless otherwise expressly stated:
- Promotional purchases are non-refundable;
- Promotional pricing cannot be combined with other discounts;
- Promotional credits cannot be exchanged for cash;
- Promotional credits may expire;
- Promotional offers may have limited availability; and
- Promotional offers may be subject to additional terms.
The terms displayed at the time of purchase control in the event of a conflict.
10. ACCOUNT CREDITS
When Fairway365 provides an account credit instead of a refund, the credit:
- May only be used for eligible Fairway365 services;
- Is not redeemable for cash unless required by law;
- May have an expiration date;
- May not be transferable unless Fairway365 permits the transfer; and
- May be subject to additional conditions.
Fairway365 reserves the right to revoke credits obtained through fraud, abuse, chargebacks, or violation of Fairway365 policies.
11. FACILITY CLOSURE OR SERVICE INTERRUPTION
If Fairway365 is unable to provide a confirmed reservation because of circumstances within Fairway365's control, Fairway365 may provide one or more of the following remedies:
- Rescheduling;
- Account credit;
- Replacement reservation;
- Partial refund; or
- Full refund.
The remedy will depend on the circumstances.
12. WEATHER AND EMERGENCIES
If Fairway365 closes or cannot safely operate because of severe weather, natural disasters, power outages, emergency situations, governmental orders, or other circumstances beyond Fairway365's reasonable control, Fairway365 may reschedule reservations or issue account credits or refunds when appropriate.
Fairway365 is not required to provide refunds for circumstances where the facility remains open and the customer voluntarily chooses not to attend, unless otherwise required by law.
13. EQUIPMENT OR SIMULATOR MALFUNCTIONS
Fairway365 makes reasonable efforts to keep all equipment operational.
If a simulator or other essential equipment becomes unavailable during a customer's reservation, Fairway365 may, depending on the circumstances:
- Attempt to repair or restore the equipment;
- Move the customer to another available bay;
- Extend the reservation;
- Provide an account credit;
- Provide a partial refund; or
- Provide another reasonable remedy.
Refunds will generally be based on the portion of the service materially affected rather than automatically refunding the entire reservation.
14. CUSTOMER DAMAGE OR MISUSE
A customer who damages Fairway365 property may remain responsible for reasonable repair or replacement costs to the extent permitted by law.
A refund or credit will not automatically eliminate a customer's responsibility for damage caused by the customer or the customer's guests.
Fairway365 may offset amounts owed against available credits where legally permitted.
15. DUPLICATE OR INCORRECT CHARGES
If you believe you were charged incorrectly, contact Fairway365 as soon as reasonably possible.
Fairway365 may investigate claims involving:
- Duplicate charges;
- Incorrect amounts;
- Failed transactions;
- Billing errors;
- Unauthorized transactions; or
- Other payment issues.
If Fairway365 determines that an error occurred, Fairway365 will take appropriate corrective action.
16. CHARGEBACKS AND PAYMENT DISPUTES
Customers should contact Fairway365 before initiating a payment dispute or chargeback when the issue can reasonably be resolved directly.
Fraudulent or improper chargebacks may result in:
- Account suspension;
- Membership termination;
- Booking restrictions;
- Loss of promotional benefits;
- Recovery of amounts owed; and
- Other remedies permitted by law.
Nothing in this section limits your legal rights to dispute unauthorized transactions.
17. HOW TO REQUEST A REFUND
To request a refund, customers should contact Fairway365 through the contact method listed on the Fairway365 website.
Please provide:
- Full name;
- Email address associated with the account;
- Reservation or transaction number;
- Date of purchase or reservation;
- Amount charged; and
- Reason for the refund request.
Fairway365 may request additional information necessary to verify the transaction.
18. REFUND REVIEW PROCESS
Refund requests may be reviewed individually.
Fairway365 may consider:
- The applicable cancellation deadline;
- Whether the customer attended the reservation;
- Whether the customer cancelled;
- The reason for cancellation;
- Equipment availability;
- Facility closures;
- Payment records;
- Previous refund history;
- Membership terms;
- Promotional terms; and
- Applicable law.
Submitting a refund request does not guarantee that a refund will be approved.
19. APPROVED REFUNDS
If a refund is approved, Fairway365 will generally return the applicable amount to the original payment method used for the purchase.
Processing times may depend on the customer's bank or payment provider.
Fairway365 does not control the processing time of a customer's bank or payment processor after a refund has been submitted.
20. PARTIAL REFUNDS
When appropriate, Fairway365 may issue a partial refund instead of a full refund.
For example, a partial refund may be appropriate when:
- A portion of a reservation was unavailable;
- A simulator malfunction materially affected part of a booking;
- A service interruption occurred during a reservation; or
- Another circumstance reasonably supports a partial refund.
21. EXCEPTIONS
Fairway365 reserves the right to make reasonable exceptions to this Policy on a case-by-case basis.
An exception made for one customer or situation does not modify this Policy or create a right to the same exception in the future.
Exceptions may be granted for circumstances such as:
- Serious emergencies;
- Significant service failures;
- Facility closures;
- Technical issues;
- Billing errors; or
- Other circumstances Fairway365 determines justify an exception.
22. NO GUARANTEE OF REFUND
Submitting a cancellation or refund request does not guarantee approval.
Refunds are governed by this Policy, the applicable reservation or membership terms, and applicable law.
Where a separate agreement provides different cancellation or refund terms, the specific agreement may control.
23. POLICY CHANGES
Fairway365 may modify this Refund & Cancellation Policy from time to time.
The updated version will be posted on the Fairway365 website with an updated "Last Updated" date.
Changes generally apply prospectively unless otherwise required by law.

25. CUSTOMER ACKNOWLEDGMENT
By making a reservation, purchasing a membership, or purchasing any Fairway365 service, you acknowledge that:
- You have read this Refund & Cancellation Policy;
- You understand the applicable cancellation deadlines;
- You understand that no-shows and late cancellations may be non-refundable;
- You understand that membership payments may be non-refundable;
- You understand that cancellation of a membership generally prevents future charges but does not automatically refund previous charges;
- You understand that refund requests are subject to review;
- You understand that Fairway365 may provide credits or other remedies instead of refunds when appropriate; and
- You agree to comply with this Policy.
